2. Orders
2.1 Types of orders
Orders can be placed
- via the Internet, on the website www.dzr4x4.com
- by telephone, Monday to Friday from 9am to 12pm and from 2pm to 6pm, 5pm on Fridays
- at the shop, located in Chinon
- by post, by sending an order form and payment to: DZR, 2 rue de l'Olive, 37500 CHINON - France
2.2 Ordering via the Internet
When visiting the website www.dzr4x4.com, the Customer chooses the desired items (each product sheet includes a detailed description, price and availability) and adds them to their basket after indicating the desired quantity. The photos appearing on the website are not contractually binding. Any indications of product colour are given purely for information and guidance and may not completely reflect the actual colour of the product.
After selecting all the desired items, the Customer accesses their basket where they are invited to choose their delivery location and method and indicate their payment method.
The Customer then logs in or creates their customer account.
At the end of this stage, the Customer is invited to confirm his order.
It is no longer possible to modify or cancel the basket after this stage, which implies full and complete acceptance of these General Terms and Conditions of Sale.
After confirming the contents of his order, the Customer will definitively confirm it by making the payment.
The Customer undertakes to pay for the confirmed order.
2.3 Order confirmation
The Customer will receive an order confirmation email summarising the items ordered, their price, the postage and packaging costs, and the total price of the order.
3. Payment
3.1 Methods of payment
Full payment is made at the time of purchase, without discount, including for items that are not in stock and require a supply lead time. Depending on the destination, the Customer can make payment:
- by credit card (in one instalment or in three or four instalments with Oney)
- by PayPal account
- by bank transfer (the order is then validated upon receipt of the order amount in our bank account; the information required to make the transfer is available in the order confirmation email sent to the Customer)
Any payment incident will result in the cancellation of the order, and the possibility for DZR to refuse subsequent orders if a dispute remains with the Customer.
Similarly, any suspicion of payment fraud will result in the order being blocked and possibly cancelled if the fraud is proven.
3.2 Secure payments
Some orders may be subject to additional verification. For example, various supporting documents may be requested from the Customer (ID, proof of address, etc.).
Processing of the order will begin upon receipt of the requested documents. Failure to receive these documents will result in cancellation of the order. The www.dzr4x4.com website also uses the 3DSecure protocol, which ensures that the card is being used by its rightful owner during each online payment.
3.3 Option to pay in 3 or 4 instalments by bank card for purchases from €100 to €3000 with Oney Bank
Oney Bank offers its partners' private customers a financing solution called “3x 4x Oney”. This personalised financing for each customer order allows the consumer to pay for purchases of products and/or services from €100 to €3000 in 3 or 4 instalments by bank card. This financing is offered to the customer with fees, under the following terms and conditions:
Conditions
This offer is reserved for private individuals (natural persons of full age) residing in France and holding a Visa or MasterCard with an expiry date later than the chosen financing period. Cards with systematic authorisation, such as Electron, Maestro, Nickel, etc., as well as e-cards, Indigo and American Express cards, are not accepted.
Subscription terms
After completing your order, simply click on the ‘3x 4x Oney payment by credit card’ button. You will then be redirected to the 3x 4x Oney web page of our partner displaying the detailed summary of your order and the personalised financing request, which you must then validate. You enter your personal details or, if you have a 3x 4x Oney account, you log in using the login details linked to your 3x 4x Oney account. You read the general terms and conditions for payment in instalments that you wish to subscribe to, which are provided in PDF format so that you can read, print and save them before accepting them. You then confirm your electronic acceptance by ticking the corresponding box. You acknowledge that the ‘double click’ associated with ticking the box to confirm that you have read the general terms and conditions constitutes consent to enter into the contract and constitutes irrevocable and unreserved acceptance of the general terms and conditions of the product. Unless proven otherwise, the data recorded by Oney Bank constitutes proof of all transactions between you and Oney Bank. If you apply for a financing solution offered by Oney Bank, the information relating to your order will be sent to Oney Bank, which will use it to consider your application for the granting, management and recovery of credit. Oney Bank reserves the right to accept or refuse your application for 3 or 4 times Oney financing. You have a 14-day cancellation period to cancel your credit.
How it works
Payment in 3 or 4 instalments by credit card allows you to pay for the order placed on our merchant site as follows:
- a mandatory deposit, debited on the day of confirmation of shipment of your order;
- two or three monthly instalments, each corresponding to a third or a quarter of the order, debited 30 and 60 days later for the 3 instalments and 30, 60 and 90 days later for the 4 instalments, which include, in the case of 3x 4x with costs, fees corresponding to 1.45% of the total amount of the order for 3 instalments and 2.2% for 4 instalments (up to a maximum of €15 for payment in 3 instalments and €30 for 4 instalments).
To better understand how 3x 4x Oney by credit card works, here are a few examples:
Examples of 3x 4x Oney by credit card, with fees, from €100 purchase and up to €3000:
Example for payment in 3 instalments: For a purchase of €150, deposit of €52.18 then 2 monthly instalments of €50
Credit for a period of 2 months at a fixed APR of 19.31%. Financing cost: €2.18 up to a maximum of €15.
Example for payment in 4 instalments: For a purchase of €400, down payment of €108.80 then 3 monthly instalments of €100
Credit over 3 months at a fixed APR of 19.61%. Finance charge: €8.80 up to a maximum of €30.
4. Availability
If an item proves to be unavailable after the order has been confirmed, the Customer will be notified by email and may cancel the order.
5. Prices
Prices are, by default, in euros, inclusive of all taxes and excluding shipping costs.
For Professional Customers registered and validated by our services and benefiting from VAT exemption, prices are in euros, excluding taxes and excluding shipping costs.
DZR reserves the right to modify its prices at any time.
6. Delivery
6.1 Delivery locations
The Customer has the choice between delivery to the delivery address indicated when the order was placed (the Customer is asked to check that the address provided is correct) or to a Relais point.
6.2 Modes of transport
DZR offers a range of carriers to deliver your parcels. Depending on the geographical area, delivery time can range from 24-48 hours (mainland France) to 6-7 working days (international and French overseas departments and territories).
The delivery time mentioned above does not take into account possible delays related to the carrier, customs or the weather (driving ban, bad weather, etc.). To these is added the one-day order preparation time after validation of the Customer's payment for any order placed after midday.
6.3 Parcel control
In the event of a delivery incident (damaged parcel, missing products, parcel resealed, etc.), the Customer must note his reservations on the delivery slip and have the carrier sign it (keep a copy of the document), and/or, if necessary, refuse the parcel.
If the parcel is delivered without a signature, the Customer must report the damage to the carrier by registered letter with acknowledgement of receipt within 3 working days.
At the same time, the Customer is invited to contact DZR as soon as possible to report the delivery incident.
7. Right of withdrawal
The professional Client has no right of cancellation for distance contracts, i.e. contracts concluded without the simultaneous physical presence of the parties. The following paragraphs on the right of cancellation only concern the private Client.
The individual Customer has the right to withdraw from this contract without giving any reason within 14 days. The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the last item.
7.1 Exercise of the right of withdrawal
To exercise his right of withdrawal, the Customer must notify DZR of his decision to withdraw from this contract by means of an unambiguous declaration (for example, a letter sent by post, fax or email)
- by post, to the following address: DZR, 2 rue de l'Olive, 37500 CHINON
- by telephone
- by email
In order to comply with the withdrawal period, it is sufficient for the Customer to send his communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. He must bear the direct costs of returning the goods.
7.2 Consequences of the right of withdrawal
The Customer must return the goods to DZR, 2 rue de l'Olive, 37500 CHINON, without undue delay and, in any event, no later than 14 days after communicating his decision to withdraw from this contract.
This period is deemed to have been observed if the goods are returned before the expiry of the 14-day period. Beyond this legal deadline, restocking fees will be invoiced. In the event of cancellation of this contract by the Customer, DZR will reimburse all payments received from the Customer, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen a delivery method other than the least expensive standard delivery method offered by DZR) without undue delay and, in any event, no later than 14 days from the day DZR is informed of the decision to withdraw from this contract. DZR will proceed with the refund using the same means of payment as the Customer used for the initial transaction, unless a different means is expressly agreed; in any event, this refund will not incur any costs for the Customer. DZR may defer the refund until it has received the goods or until the Customer has provided proof of shipment of the goods.
The return costs are payable by the Customer.
8. Returns and warranty
For all parts with a defect, an exchange will be made quickly or a credit note for their value, excluding postage, after inspection at DZR's premises.
Defective parts must be returned within a maximum of 14 days from the date on which the Customer communicates his decision to cancel.
After the cancellation period, the Customer must not return any parts without first contacting DZR to obtain a return authorisation. The Customer will then receive all the necessary instructions to ensure that the return is carried out under the best possible conditions.
Under no circumstances will DZR accept returns sent cash on delivery, or postage due, or that are poorly packaged.
Returns are limited to items that are in perfect condition, clean, and returned in their original packaging.
DZR does not accept returns for items on special order.
For orders to professional Customers, no product may be returned without DZR's prior agreement. If DZR accepts the return, the Customer is responsible for the shipping costs.
No warranty applies to a product offered or a gift.
9. Warranty
The Customer benefits from the legal warranty against hidden defects and lack of conformity on all products delivered to him.
Under the legal warranty for hidden defects and lack of conformity, DZR's liability is limited to the starting value of the parts. DZR does not accept any direct liability for damage caused by the use of the products. DZR also does not accept any liability for work such as: dismantling and/or installation, diagnostics and expert assessments, loss of use of the vehicle, loss of time, inconvenience or any other consequential expenses. There is no guarantee for special competition parts.
10. Approval
Some parts that we offer for sale on the DZR online shop are for the sole purpose of improving the performance of the vehicle, ONLY intended for use in competition or on private land. Parts that modify the character of the vehicle in relation to its approval on French territory make it unsuitable for road use. The seller cannot be held liable in the event of the Customer's failure to comply with the relevant legal obligations.
11. Liability
DZR cannot be held liable for any damage caused directly or indirectly for any component not invoiced by it, in particular when the failure of one of these parts is caused by other neighbouring components or improper handling.
The products may be resold according to their intended use. However, DZR cannot be held responsible for the failure or malfunction of the products in the event of resale by the buyer to its own customers.
The same applies in the context of Homologations: parts sold in the categories named ‘OFF ROAD’ or similar are not approved for use on public roads.
DZR cannot be held responsible for any immaterial damage such as the loss of customers, loss of turnover, loss of production, loss of margin, action brought by a third party against the professional Client or conviction of the latter.
12. Industrial property
Plans, diagrams, specifications, recommendation documents, catalogues, brochures, photos and instructions, patents, product references and packaging remain the property of DZR.
Consequently, the Client is prohibited from distributing or reproducing any of these without the prior consent of DZR.
13. Retention of title
Delivered products remain the property of DZR until full payment of the order price.
14. Transfer of risk
The transfer of risk of damage or loss of goods shall take place when the Customer takes possession of the delivered goods or when the goods are handed over to a carrier appointed by the Customer, other than one of those proposed on the Website www.dzr4x4.com.
15. Disputes
These General Terms and Conditions are subject to French law. In the event that one of the clauses of this contract is null and void due to a change in legislation or regulations, this shall in no way affect the validity of and compliance with these General Terms and Conditions of Sale.
The language of the contract is French.
16. The Data Protection Act
In accordance with the French Data Protection Act of 6 January 1978, the Customer has the right to access and rectify personal data concerning him/her: the information requested is necessary for the processing of his/her order.
